Terms and Conditions

Without obligation market appraisal, and advice on any required repair and legal obligation concerning gas, electricity and furniture regulations required to ensure that your property is let with the minimum of delay.

Marketing via company website, Zoopla, homes24.co.uk, Prime Location and Globrix.

Conduct accompanied viewings, 6 days a week including early evenings.

Tenants are fully referenced via a reputable referencing agency (rentchecks.com) including a check for County Court Judgements, credit history, electoral roll, current employer and any current or previous landlord.

Arrange landlord Gas Safety Record and electrical inspections by qualified DEA, Gas Safe and NIC EIC contractors.

Compilation of a detailed inventory and schedule of condition along with full ‘check-in’ and ‘check-out’ of tenants.

Arrange transfer of council tax & water rates and take meter readings upon handover and vacation of property

Expertly prepared Assured Short hold Tenancy Agreement and associated paperwork.

Collection of one months rent in advance and one months’ rent plus £100 as a deposit.

Fully trained members of staff to assist you or your tenant with any problems or queries.

Registering and protecting of the tenants deposit with the Tenancy deposit Scheme and providing assistance with disputes.

Arrange for completion of Energy Performance Certificate, if required.

Maintain gas and electrical safety records on your behalf. (If already obtained a copy must be provided to Milpark Property Management for their records).

Arrange standing order from tenants’ bank account to ‘Milpark’ account, monitoring to ensure monthly payment is received.

Monthly statement to landlord and transfer to nominated account, less agreed fees and contractors invoices.

Undertake property visits and advise landlord of any repairs required. Arranging completion of required repairs by fully qualified contractors.

Liaise with landlord where a problem arises which may require the issue of relevant legal notices and/or actions.

 

Consent to Let

As landlords you are legally required to obtain approval/consent to let your property from your mortgage company, buildings and contents insurer, freeholder and management company (where applicable) and ensure that any insurance in place is sufficient and current particularly in relation to public liability.

 

Property Condition

Ensure that the property is clean and in a good repair and decorative order. Milpark Property Management strongly recommends that a full professional clean, to include appliances and carpets, has been carried out at the property before any tenancy commences. The tenant is then expected to maintain and return the property in the same condition, with consideration for fair wear and tear.

 

Garden

We recommend that basic gardening equipment is provided in both furnished and unfurnished accommodation if the tenants are required to maintain the outside areas. Dependant upon the size of the garden we do not feel that the tenant should be required to undertake the spring and autumn pruning of trees and shrubs, and therefore recommend that this remains the responsibility of the landlord. Milpark Property Management can arrange said works if required.

 

Access to the Property

Milpark Property Management will require one full set of keys per tenant (if over the age of 16) and one full set of keys for emergencies, should access be required.

 

Gas Safety (Installation & use) Regulations 1998

You are legally required under current legislation to have all gas appliances and supply within the property tested annually and a Landlord Gas Safety Certificate issued, which must be provided to the tenant within 28 days of completion.

 

Electrical Equipment (Safety) regulations 1994

The electrical legislation is at present only a recommendation however; penalties are severe and we therefore strongly recommend a hard wire test is completed every 5 years and PAT testing, for individual appliances, completed annually. All relevant instruction manuals for appliances should be left at the property for the use of the tenant.

 

Furniture and Furnishing (Fire) (Safety) regulations 1988 as amended

All upholstered furniture in rented accommodation including settees, chairs, cushions, mattresses, pillows, duvets, dining chair seats etc, must adhere to the above regulations and pass the match, cigarette and ignitibility tests. The appropriate label evidencing conformity must be present on each item of furniture. If a label cannot be found you must either provide proof of purchase or remove the item from the property as it will be presumed that the item does not conform.

 

Building regulations 1991 – Smoke Alarms

All properties built since June 1992 must be fitted with mains operated interlinked smoke alarms on each floor. Whilst these regulations do not apply to properties built prior to June 1992 we strongly recommend that smoke alarms are fitted and regularly checked. We also recommend that the batteries are changed at the commencement of every new occupation.

 

Energy Performance Certificates (EPCs)

The government have introduced new regulations concerning Energy Performance Certificates on properties for rent. To comply with the new legislation all properties that are let after 1st October 2008 will need to have an EPC which will indicate the current energy efficiency of the property and also its potential energy efficiency. The EPC must be available at the time of commencing the marketing of the property. Milpark Property Management can arrange this on your behalf, at cost, if required.

 

Tenancy Deposit Scheme

The Tenancy deposit Scheme (TDS) was introduced on 6th April 2007. All deposits paid on Assured Short Term Tenancies commencing after this date must be registered and protected with a regulated scheme. All deposits held by Milpark Property Management are held in a separate client account and are registered with My Deposits and so are protected by the Tenancy Deposit Scheme.

The deposit will be refunded to the tenant at the end of the tenancy subject to the satisfactory check of the property against the Inventory and Schedule of Condition. This check is conducted by Milpark Property Management.

Please note: due consideration must be given to fair wear and tear.

 

Rent Guarantee and Legal Protection

Whilst every endeavour is made to ensure that all tenants are suitable we cannot foresee future problems such as redundancy, marital breakdown etc. We therefore strongly recommend a rent protection and legal insurance policy is taken out to cover you the landlord. Milpark Property Management DO NOT provide this cover.

Tax

You may have a tax liability from your rental income. It is your responsibility to deal with this correctly. Milpark Property Management offers no advice and accepts no responsibility for this.
